Most Allegations Tossed, Focus Narrows to Retaliation
A federal judge has thrown out the bulk of actor Blake Lively's sexual harassment claims against co-star and director Justin Baldoni, significantly paring down a lawsuit that had accused Baldoni of mistreatment during the filming of the romantic drama It Ends with Us. Judge Lewis Liman dismissed 10 of the 13 allegations, including those centered on harassment, defamation, and conspiracy, leaving only a narrower focus for an upcoming trial.

The judge's ruling, issued after more than a year of contentious legal back-and-forth, suggests that many of Lively's allegations could not proceed under federal civil rights law, partly due to her status as an independent contractor rather than an employee. In his analysis, Liman noted that some of Baldoni's alleged conduct appeared to be directed toward Lively's character within the context of the film's narrative, rather than toward Lively herself. This perspective, the judge indicated, must be considered within the milieu of a movie that depicts adult themes and potentially volatile relationships.

Lively's legal team, however, has signaled a determination to press forward on the remaining aspects of her case. A statement from Lively's counsel indicated an eagerness to testify at trial, aiming to "shine a light on this vicious form of online retaliation." The central remaining claim appears to pivot on allegations that Baldoni orchestrated a smear campaign in retaliation for Lively's complaints about misconduct on set. This campaign, according to Lively's side, involved sharing and amplifying negative stories about her online to damage her reputation.

Baldoni's Counter-Actions
Baldoni had previously filed defamation lawsuits against Lively and her husband, actor Ryan Reynolds, claiming they sought to tarnish his career through the allegations. These counter-claims, however, were largely dismissed by Liman in June. Baldoni's legal team expressed satisfaction with the dismissal of the harassment claims against the individual defendants, stating their gratitude for the court's review.

A Glimpse of Private Exchanges
The legal entanglement has also brought to light personal communications, including text messages exchanged between Lively and other notable figures like Taylor Swift, which were reportedly considered as evidence. The case is currently scheduled for a trial beginning May 18. Baldoni has consistently denied any wrongdoing.
Context of the Film
It Ends with Us, a film co-starring Lively and Baldoni, who also directed, reportedly delves into themes of domestic violence. Liman's decision highlighted that Baldoni's actions, such as suggesting scenes involving sexual acts in the development of such a film, did not necessarily create a legally hostile environment. The lawsuit initially involved claims against Baldoni, his production company Wayfarer Studios, and other individuals. While the harassment and defamation claims against Baldoni personally have been largely dismissed, Lively may still pursue claims of retaliation against Wayfarer Studios, as well as contract and aiding and abetting claims against other parties.
