The Fair Work Commission (FWC) has affirmed Jetstar's decision to terminate his employment, concluding that his alleged workplace conduct, particularly remarks made to an apprentice, warranted dismissal. Mcrae had argued his sacking was harsh, with claims that his comments were either taken out of context or not exclusively directed at the younger colleague.

The core of the dispute revolved around alleged comments Mcrae made, including telling an apprentice, "You are all pu**ies now, it's ridiculous, back when I was an apprentice, we used to cop all sorts of abuse."
