LEGAL SHIELD FOR JAHANGIR KHAN AMIDST PENDING CASES
The Calcutta High Court has granted interim protection from coercive action to Jahangir Khan, the Trinamool Congress (TMC) candidate for the Falta Assembly constituency, until May 26. This judicial intervention comes just days before the scheduled repoll in Falta on May 21.
The order, issued by Justice Saugata Bhattacharyya, provides Khan a temporary reprieve from arrest in connection with multiple criminal prosecutions registered against him. His legal counsel, Kishore Dutta, formerly West Bengal's Advocate General, had moved the court seeking disclosure of all First Information Reports (FIRs) lodged against Khan and immediate protection.
Khan's plea highlighted that these cases were filed in rapid succession, arguing they were designed to impede his campaign efforts for the repoll. The court also directed Khan to adhere strictly to the Election Commission's directives, specifically concerning the non-obstruction or intimidation of voters and other election participants.

The Falta constituency in South 24 Parganas district saw its initial April 29 poll countermanded due to widespread allegations of irregularities.
BACKGROUND TO THE LEGAL CHALLENGE
The legal maneuver by Jahangir Khan unfolds against a backdrop of heightened political tensions in the Falta constituency. Khan's candidacy for the upcoming re-election is marked by a series of criminal cases that his legal team asserts are strategically filed to disrupt his electoral prospects.
Senior advocate Kishore Dutta emphasized before the bench that Khan faced a continuous stream of new cases during the election period, arguing that this constitutes harassment and restricts his ability to engage with the electorate. The core of the argument revolved around Khan's right to be informed about all pending legal actions and to seek redressal, while simultaneously campaigning for the critical re-poll.
While the court granted interim relief, it also stipulated that Khan must cooperate with the ongoing investigations. The specifics of the criminal charges remain a point of focus, with Khan's legal team pressing for a complete disclosure of all FIRs.

Reports suggest that political adversaries have made critical remarks regarding Khan's situation. Notably, West Bengal Chief Minister Suvendu Adhikari has been quoted suggesting Khan's actions indicate an unwillingness to face the electorate, while a TMC spokesperson, Arup Chakraborty, indicated a lack of awareness regarding Khan's contestation of the repoll, suggesting a possible withdrawal. However, the exact status of Khan's participation in the re-poll remains unclear from the provided information.
