Judicial Intervention in Inheritance Conflict
The Delhi High Court has issued an interim injunction freezing the assets of the late industrialist Sunjay Kapur, in a move that provides significant relief to his children from his marriage to actor Karisma Kapoor. The court's order comes amidst a contentious inheritance dispute, primarily between Kapur's children, Samaira and Kiaan Kapoor, and his third wife, Priya Kapur.
The High Court's directive aims to preserve Kapur's substantial estate, estimated at approximately Rs 30,000 crore, preventing any dissipation of assets pending the resolution of doubts surrounding a contested will. The court explicitly restrained Priya Kapur from dealing with, transferring, or pledging any of Sunjay Kapur's personal assets, including bank accounts, cryptocurrency holdings, artworks, and company shares. The judicial observation underscored that the estate "must be preserved and not dissipated."
The court also emphasized that the onus rests upon Priya Kapur to allay suspicions regarding the authenticity of the will attributed to Sunjay Kapur. This stance follows allegations from Samaira and Kiaan that the will might be forged and that an incomplete disclosure of assets has been provided. Specifically, the children claim a one-fifth share of the movable and immovable assets, including demat accounts, artworks, and crypto investments. The court, however, clarified that it does not possess jurisdiction over any foreign immovable assets.

Allegations and Court's Observations
Kiaan and Samaira have accused Priya Kapur of forging a will and presenting an incomplete inventory of their late father's possessions. Reports suggest that items such as expensive polo horses and luxury wristwatches have been omitted from the disclosed assets. The court acknowledged that the children have made out a "prima facie case," thus justifying the interim restraints.

During the proceedings, opposing counsel highlighted the beneficiary status of Priya Kapur, demanding strict proof of the will's validity. Priya Kapur's legal representatives, however, denied allegations of asset concealment, asserting that full disclosures were made. The court has requested the submission of bank and account details from the respondents.
Wider Family Entanglement
The dispute over Sunjay Kapur's estate has extended beyond the immediate family members involved in the inheritance claim. Reports indicate that Kapur's mother, Rani Kapur, and his sister, Mandira Kapur, are also involved in challenging the will and the division of assets. Rani Kapur has reportedly filed a separate challenge, and there have been suggestions of mediation for broader family conflicts. The suit itself names Priya Kapur, her minor son, Rani Kapur, and the executor of the will, Shradha Suri Marwah, as defendants.
