The conflict originated in February 2025 when Kardashian, an advocate for criminal justice reform, posted an Instagram story aimed at raising awareness for a death row inmate named Ivan Cantu. In a widely publicized error, she used a photograph of a different Ivan Cantu, a New York resident. This mistake, Kardashian’s attorneys claimed, was a "simple mistake" and the image was removed "almost immediately once the error was discovered."
Cantu’s initial lawsuit accused Kardashian of slander, libel, invasion of privacy, and intentional infliction of emotional distress. He claimed the misidentification caused him "emotional and mental anguish, psychological harm, embarrassment, anxiety, loss of sleep, nightmares, post-traumatic stress, headaches, need for medical care, need for emotional counseling and loss of reputation." A federal judge ultimately dismissed this lawsuit, ruling that Cantu failed to prove he suffered any actual injury from Kardashian’s use of his image.

Despite the dismissal of his suit, the legal entanglement continues as Kardashian pursues reimbursement for her legal costs. Cantu's attorney, Greg Sobo, has emphasized the potent reach of social media and the potential for immense harm, even from an unintentional post, especially given Kardashian's vast audience and income derived from her online presence. He also highlighted Cantu as a "very private family man with two daughters" who was experiencing personal tragedy at the time of the incident.
