Deisy Rivera Ortega, wife of active-duty U.S. Army Sergeant Jose Serrano, was detained by Immigration and Customs Enforcement (ICE) agents on April 14 during an immigration appointment in El Paso, Texas. The incident has ignited controversy, particularly due to Serrano's 27 years of military service, including deployment in Afghanistan, and claims that Rivera Ortega had been adhering to immigration procedures.
Rivera Ortega now faces potential deportation to a third country, identified as Mexico, a nation where neither she nor her husband claim any ties or support systems. This prospect has caused significant distress to Sergeant Serrano, who has a history of medical conditions including PTSD, depression, and traumatic brain injury, which have reportedly worsened since his wife's detention. His legal team, led by attorney Matthew Kozik, has filed a habeas petition in federal court, asserting that Rivera Ortega's detention is unlawful.

"They put handcuffs on and they took her away," Serrano recounted, detailing the moment his wife was taken into custody.
The Department of Homeland Security (DHS), which oversees ICE, stated that Rivera Ortega entered the U.S. illegally. However, Serrano maintains that his wife has been compliant with immigration requirements and that a "Parole in Place" application, intended to offer deportation protection to certain undocumented immigrants married to U.S. service members, was submitted on her behalf last year and remains pending. The DHS confirmed an existing deportation order against Rivera Ortega from December.
The detention has drawn criticism from various quarters, with some labeling ICE actions as excessive. The situation is complicated by the fact that U.S. service members are generally restricted from traveling to Mexico, which would make visiting Rivera Ortega in that country if deported nearly impossible, forcing Serrano into a difficult choice between his military career and his wife. Rivera Ortega reportedly worked at hotels on Fort Bliss prior to her arrest.
