A civil lawsuit has been filed against OpenAI, the maker of ChatGPT, by the family of Maya Gebala, a 12-year-old girl critically injured in a mass shooting in Tumbler Ridge, British Columbia. The suit alleges the artificial intelligence company possessed knowledge of the shooter's violent intentions and failed to alert authorities, a failure that could have prevented the attack.
The lawsuit centers on allegations that OpenAI's chatbot, ChatGPT, engaged in multiple conversations with the shooter, Jesse Van Rootselaar, in the period leading up to the February 10th incident. These discussions allegedly involved topics of gun violence and mass casualty scenarios.

It is further claimed that OpenAI banned the shooter's initial account for violating platform policies, yet a second account was later identified and used to continue these disturbing conversations, again without notification to law enforcement. The family contends that this inaction by OpenAI directly contributed to Maya Gebala sustaining three gunshot wounds.

Allegations of Prior Knowledge and Inaction
The legal action, filed in B.C. Supreme Court, asserts that OpenAI had prior knowledge of Van Rootselaar's concerning conversations but neglected to inform authorities before the shooting occurred. The claim points to the shooter's alleged interactions with ChatGPT, where violent content and plans were discussed, suggesting the technology company was aware of the developing threat.
According to court documents, Maya Gebala was shot three times at close range. One bullet struck her head, another her neck, and a third grazed her cheek. The lawsuit states these injuries have resulted in a catastrophic brain injury, leading to permanent cognitive and physical disabilities. Her sister, Dahlia Gebala, who was present at the school but physically unharmed, has reportedly suffered from post-traumatic stress disorder, anxiety, depression, and sleep disturbances as a result of the incident.

The Tumbler Ridge Attack
The mass shooting on February 10th in Tumbler Ridge, a small community in northeastern British Columbia, claimed the lives of the shooter's mother and 11-year-old brother. Jesse Van Rootselaar, 18, then proceeded to the Tumbler Ridge Secondary School, where she killed five students and one educator before dying from a self-inflicted gunshot wound.
OpenAI's Response and Context
OpenAI has reportedly stated they considered but did not alert police regarding the activities of the individual involved in the shooting. The company has also indicated that they found a second account linked to the shooter after the first was suspended. A statement from OpenAI was released following discussions on March 5th. The lawsuit's assertions draw upon media reports, public official statements, and OpenAI representatives' comments. The head of OpenAI has reportedly expressed intent to apologize to the families affected by the tragedy.
